General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (GTC) govern the contractual relationship between the provider Miroslav Szturc (ID / Reg. No.: 22184805, Dlouhá 3403/2b, 702 00 Ostrava, Czech Republic, operator of www.public-chat.online) and the registered user regarding access to the online communication platform and activation of the Public Chat Messenger.

By registering an account, ordering annual messenger activation, or participating in the referral program, the user explicitly accepts these terms.

The contract is concluded upon successful registration and payment of the annual 12 EUR fee, or automatically upon accumulating 30 verified unique visitors via the personal VIP referral link.

Technical activation takes place immediately in real time, granting direct access to start private messaging with other registered community members.

4. Prices and Payment

The activation fee for the Public Chat Messenger is a one-off payment of 12 EUR granting full messaging access for 365 days. All prices are final and include applicable statutory taxes. There are no hidden subscription traps or automatic recurrent billings.

Alternatively, users may unlock full messaging access free of charge by collecting 30 unique referral clicks on their VIP invite link.

5. Fulfillment & Execution of Services

The digital messaging service is provided electronically through web browsers without the need for additional software installation. Execution begins immediately upon payment confirmation or upon reaching the 30-click milestone.

The user is responsible for maintaining the confidentiality of their login credentials. Accounts and messaging licenses are personal and non-transferable.

6. Waiver of Right of Withdrawal

Pursuant to European consumer law regarding digital services, the statutory right of withdrawal expires immediately upon complete technical activation of the messenger, provided that the user:

• Expressly requested immediate technical execution prior to the expiration of the 14-day statutory withdrawal period.
• Acknowledged that they lose their right of withdrawal once digital messenger access is unlocked.

7. Code of Conduct & Anti-Abuse Rules

The platform is designed exclusively for respectful, lawful interpersonal communication. It is strictly prohibited to:

• Send spam, commercial advertising, bulk unsolicited messages, or scam attempts.
• Manipulate referral click counters using automated bots, click-farms, or proxy scripts.
• Harass, threaten, or insult other community members, or share unlawful content.
• Upload child sexual abuse material (CSAM), non-consensual sexual images, or engage in extortion (strictly reported to law enforcement under the DSA).

Any violation, bot manipulation, or harassment will result in permanent account suspension without refund.

8. System Availability

The provider strives for 99.5% server availability. Necessary technical maintenance or internet infrastructure outages beyond our control do not constitute a breach of contract.

9. Platform Nature & Liability Disclaimer

The provider operates www.public-chat.online solely as a technical host and software platform for interpersonal communication.

The following liability limitations apply:

• User Content: The provider acts as a technical host provider. Messages exchanged between users represent exclusively the personal views of the respective sender.
• Financial Independence: Payments of 12 EUR cover technical messenger software access for 365 days.
• No Response Guarantee: The platform enables sending messages and initiating calls, but does not guarantee that other community users will respond.
• Technical Downtime: The provider assumes no liability for external network downtime or payment gateway interruptions.
• Compliance & DSA Notice: In accordance with the EU Digital Services Act, unlawful messages and media reported by users will be removed and violators promptly banned.

10. Termination & Account Suspension

The provider reserves the right to terminate or suspend user accounts without prior notice or refund in case of severe GTC violations, bot-clicking fraud, harassment, or unlawful conduct.

11. Privacy Policy

The collection and processing of personal data is governed strictly by the GDPR as outlined in our separate Privacy Policy.

12. Final Provisions

These terms are governed by the statutory laws of the Czech Republic and applicable European consumer regulations.

Should any individual provision of these GTC be invalid, the validity of the remaining provisions remains unaffected.
